Terms of Service

1. Acceptance of Terms

By accessing or using the SecureShare peer-to-peer file transfer service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service.

2. Description of Service

SecureShare provides a platform for users to transfer files directly between their devices using WebRTC technology. Key features include peer-to-peer transfer, optional password protection, download limits, and expiry controls. Files are encrypted in transit and are not stored on our servers.

3. User Accounts (If Applicable)

If account registration is offered, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.

4. User Conduct

You agree not to use the Service to:

  • Transfer any material that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Transfer any material that you do not have a right to make available under any law or under contractual or fiduciary relationships.
  • Transfer any material that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Violate any applicable local, state, national, or international law.

You acknowledge that SecureShare does not pre-screen content or files, but that SecureShare and its designees shall have the right (but not the obligation) in their sole discretion to refuse or remove any content that is available via the Service.

5. Intellectual Property

The Service and its original content (excluding files transferred by users), features, and functionality are and will remain the exclusive property of McCullagh LABS and its licensors. The Service is protected by copyright, trademark, and other laws of both the [Your Country] and foreign countries.

6. Disclaimers

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

McCullagh LABS does not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the results of using the Service will meet your requirements.

7. Limitation of Liability

In no event shall McCullagh LABS, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Because the Service facilitates direct peer-to-peer transfers, McCullagh LABS is not responsible for the content of files transferred or the actions of users using the service.

8. Indemnification

You agree to defend, indemnify and hold harmless McCullagh LABS and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content transferred using the Service.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.

Upon termination, your right to use the Service will immediately cease.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction, e.g., State, Country], without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
